General Terms & Conditions

These General Terms and Conditions (T&C) govern all contracts concluded between WK Haustechnik GmbH (hereinafter "WK") and its customers concerning plumbing, heating and ventilation works as well as service and maintenance. Any deviating customer terms apply only if accepted in writing.

WK's quotations are valid for 30 days unless stated otherwise. The contract is concluded upon WK's written or electronic confirmation of the order. Verbal side agreements require written confirmation to be valid.

Unless stated otherwise, prices are in Swiss francs (CHF) and exclude VAT. Prices stated in quotations and order confirmations are based on the material and labour costs in force at the time of issue · material variations may be passed on proportionately.

Deadlines are indicative unless expressly agreed as binding. Delays not attributable to WK (supply shortages, weather, force majeure) do not entitle the customer to terminate. Additional works required for performance are invoiced separately.

Invoices are payable within 30 days net of the invoice date. In the event of late payment, default interest of 5% is due in accordance with Art. 104 para. 1 CO. Reminder fees are charged separately.

Delivered material remains the property of WK Haustechnik GmbH until payment in full.

WK warrants its work in accordance with SIA standard 118 and applicable construction standards · generally 5 years from acceptance for building works. Defects must be reported in writing immediately upon discovery. The warranty does not cover damage resulting from improper use, lack of maintenance, or third-party interventions.

WK is liable for damage caused by gross negligence or intent. Liability for slight negligence, consequential damage and loss of profit is excluded to the extent permitted by law.

• Strikes, lock-outs, governmental measures.
• Natural events, pandemics.
• Supply-chain disruptions and other events beyond WK's control.

In such cases, agreed deadlines are extended reasonably, without giving rise to a claim for damages.

WK treats customer data confidentially and in accordance with the privacy policy separately available on the website.

Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered office of WK Haustechnik GmbH in Bassersdorf · mandatory rules of jurisdiction reserved.
